Unused Data Quota Cannot Simply Expire: What Are the Rules?
Customers who purchase mobile data must be offered a service option that protects unused quota. The principle follows Indonesia’s Constitutional Court Decision No. 273/PUU-XXIII/2025, delivered on July 23, 2026.
The decision does not require every mobile-data package to provide unlimited rollover. Operators must provide a service choice that keeps unused paid quota active and usable, while the form of protection may differ across products.
The Ministry of Communication and Digital Affairs, or Komdigi, followed with Ministerial Circular No. 4 of 2026 on August 28. The circular provides an implementation framework and clarifies the information operators must present to customers.

What Must Operators Provide?
An operator may not unilaterally erase a paid benefit without providing a protection mechanism that the customer can choose. Komdigi identified several possible arrangements:
Rollover to the next service period.
Extension of the active period.
Transfer of quota benefits.
Compensation through another benefit.
A refund.
Another consumer-protection mechanism that is not detrimental.
Clearly disclosed non-rollover packages, provided customers also have access to a service choice that protects unused quota.
The list means that a cash refund is not automatic in every case. An operator may use another mechanism if the terms are clear, the consumer can make an informed choice, and paid benefits are not removed unilaterally.
The term “non-rollover” also requires careful reading. A package may still have a limited validity period if that feature is disclosed before purchase and a compliant alternative protecting unused quota is available.

Package Information Must Become Clearer
Operators must describe package characteristics in straightforward language. Core information includes price, quota volume, validity, usage segmentation, fair-use terms, expiry, and treatment of unused data.
Transparency matters because a “50 GB” package may not provide 50 GB for unrestricted use. Portions may apply only to specific applications, times, networks, or regions.
The rule will have limited value if essential information remains buried in lengthy terms. A customer should be able to see, before purchase, whether unused quota will roll over, receive an extension, be transferred, be compensated, or expire under the selected service option.
Example: 18 GB Remaining at the End of the Period
A user buys a 50 GB package valid for 30 days. After 30 days, the user has consumed 32 GB and has 18 GB remaining.
The ruling does not automatically make the remaining 18 GB valid forever. The operator could provide several options.
A. Rollover
The remaining 18 GB moves to the next period, possibly subject to renewing the service or purchasing an eligible package. Any condition should be visible before the consumer chooses the package.
B. Validity Extension
The unused quota remains usable for a defined additional period. The operator should explain how long the extension lasts and whether the customer needs to take any action.
C. Transfer or Compensation
Some or all of the benefit may be transferred, converted, or replaced with another benefit. The conversion method and value should be transparent enough for the customer to judge whether the protection is reasonable.
D. Refund
A refund may be one option. Neither the ruling nor the circular establishes that every unused quota balance must be reimbursed in cash at full value.
Can Operators Charge an Additional Fee?
Komdigi states that users should not be charged an additional fee merely to retain or use quota for which they have already paid. The purpose is to prevent quota protection from becoming a second charge for the same benefit.
This principle should be distinguished from general package pricing. Operators may still offer packages with different features, validity periods, and prices. The key issue is whether a user is asked to pay again solely to prevent an already-purchased benefit from being erased.
Consumers should compare total price, validity, and quota treatment. A more expensive rollover package is not necessarily the most economical option if its usage segmentation or validity does not match the user’s needs.
What Should a Customer Do if Quota Disappears?
Evidence is essential when submitting a complaint. Consumers should preserve:
A screenshot of the package page before purchase.
Package name, price, volume, and validity.
Rollover or quota-protection terms.
Proof of payment.
A screenshot of remaining quota close to expiry.
Notifications sent by the operator.
Customer-service communications.
Complaint and ticket numbers.
The complaint should normally begin through the operator’s official channel. If unresolved, the customer can follow the complaint and supervision channels announced by Komdigi, attaching a chronology and supporting records.
Implementation Still Needs to Be Tested
The circular required operators to submit an initial report by September 28, 2026 and periodic reports thereafter. As of September 29, the official sources reviewed for this article did not display a public industry-wide summary showing which operators had reported, which products had changed, or whether enforcement measures had been imposed.
The absence of a public summary does not prove non-compliance. It means that consumers cannot yet evaluate implementation across the industry from publicly available data.
The next test will be visible changes to product pages, expiry notices, claim mechanisms, and Komdigi’s published supervision results.
Conclusion
The Constitutional Court ruling turns unused quota from a product-policy issue into a question of protecting a paid consumer benefit. Operators must provide a compliant service choice and explain how unused quota will be treated before purchase.
The rule does not make every quota balance valid forever, nor does it guarantee a cash refund for every package. Protection may involve rollover, extension, transfer, compensation, refund, or another non-detrimental mechanism.
Success should not be measured only by whether operators submit reports. Consumers need to see whether meaningful choices are available, whether information is easy to find, and whether complaints are resolved when quota is removed contrary to the stated terms.
